This Refund and Cancellation Policy explains how payments for services provided by [LEGAL COMPANY NAME], doing business as AD•SCALE (“AD•SCALE”, “we”, “us”), are treated, when refunds may be available, and how customers may cancel recurring services. It forms part of, and must be read together with, our Terms of Service.
01.Scope and Definitions
This policy applies to all paid services that AD•SCALE offers to business customers, including but not limited to: advertising infrastructure access, managed ad account access, agency ad account access, Meta Business Manager solutions, official API and business messaging solutions, onboarding, account management, consulting and support (“Services”).
AD•SCALE provides Services exclusively on a business-to-business (B2B) basis to legal entities, registered businesses, agencies and professionals acting in a commercial capacity. AD•SCALE does not market or sell Services to consumers as defined under any applicable consumer protection law.
02.Nature of Services
Our Services consist primarily of operational support, account configuration, technical enablement, and access to third-party advertising platforms operated by independent providers (such as Meta Platforms, Inc.). AD•SCALE is not Meta and is not endorsed by, affiliated with, or controlled by Meta. AD•SCALE does not control third-party platforms, their policies, enforcement decisions, account approvals, restrictions or bans.
Because Services involve significant up-front operational work, allocation of internal resources, and access to third-party infrastructure that begins as soon as activation occurs, fees are generally non-refundable once Service activation has started.
03.General No-Refund Rule
All fees are non-refundable once any of the following has occurred:
- AD•SCALE has begun the onboarding process, including KYC, business verification or documentation review;
- an ad account, Business Manager asset, API access, messaging asset, or any other access has been provisioned, assigned, transferred or shared with the customer or its designees;
- consulting, strategy, or operational hours have been delivered, scheduled and reserved, or work product has been prepared;
- ad spend has been processed, deposited, advanced or made available through any AD•SCALE-managed asset.
Subscription fees, monthly service fees, setup fees, activation fees, performance fees, minimum commitments and platform access fees are non-refundable except as expressly stated in this policy or as required by applicable law.
04.Limited Exceptions
4.1 Pre-activation cancellation
If a customer cancels a paid order in writing within [REFUND WINDOW] of payment and before AD•SCALE has performed any of the activities listed in Section 3, AD•SCALE may, at its sole discretion, issue a refund of the prepaid amount, less any third-party fees, processing fees, and documented out-of-pocket costs already incurred.
4.2 Duplicate or erroneous charges
AD•SCALE will refund verified duplicate charges or charges processed in error within a reasonable time after the issue is confirmed by our billing team.
4.3 Service not delivered due to AD•SCALE
If AD•SCALE is unable to deliver a Service for reasons solely attributable to AD•SCALE and no equivalent substitute is offered or accepted within [SERVICE ACTIVATION PERIOD], AD•SCALE may, at its sole discretion, refund the prorated unused portion of the prepaid fees or issue a service credit.
4.4 Mandatory legal exceptions
Nothing in this policy limits any non-waivable refund right that applies to the customer under mandatory applicable law.
05.Non-Refundable Items
The following are strictly non-refundable in all circumstances:
- fees paid to third-party advertising platforms, including ad spend, platform fees, and currency conversion costs charged by such platforms;
- amounts already spent or committed on advertising campaigns, regardless of campaign performance, ad rejection, account restriction or suspension by the platform;
- fees associated with account suspensions, restrictions, bans, content removals, ad disapprovals or policy enforcement actions taken by Meta or any other third-party platform;
- fees associated with violations by the customer of AD•SCALE's Acceptable Use Policy, Terms of Service, or third-party platform policies;
- onboarding fees, activation fees, KYC and verification fees;
- consulting hours that have been scheduled, delivered or for which preparatory work has been performed;
- expedited service or rush fees;
- service credits, vouchers, promotional balances and any non-cash incentives.
06.Chargebacks and Disputes
Customers agree to contact AD•SCALE first to resolve any billing concern before initiating a chargeback or payment dispute with their bank or payment provider. Initiating a chargeback for a charge that is valid under this policy and the Terms of Service is a material breach and may result in immediate suspension or termination of all Services, revocation of access to ad accounts and Business Manager assets, recovery of related costs, and referral to a collections process.
Billing inquiries should be sent to [BILLING EMAIL].
07.Cancellation of Recurring Services
Recurring Services may be cancelled by providing written notice to [BILLING EMAIL] at least [CANCELLATION NOTICE PERIOD] before the next renewal date. Upon effective cancellation:
- no further renewal charges will be applied;
- any minimum commitment or contractual term agreed by the customer remains payable in full;
- Service access ends at the conclusion of the current paid period, except where earlier termination is required for compliance reasons;
- fees already paid for the current period are not refunded on a prorated basis unless expressly required by applicable law.
08.Suspension and Termination by AD•SCALE
AD•SCALE may suspend or terminate Services without refund where the customer (i) breaches the Terms of Service, the Acceptable Use Policy, or third-party platform policies, (ii) engages in fraudulent, abusive, deceptive or unlawful activity, (iii) fails to pay any amount when due, (iv) provides false or misleading information during onboarding, or (v) where continuation would expose AD•SCALE or any third-party platform to legal, financial or reputational risk. Termination for cause does not entitle the customer to any refund.
09.How to Request a Refund
Eligible refund requests must be submitted in writing to [BILLING EMAIL] and include:
- the registered business name and account identifier,
- the order or invoice reference,
- the date and amount of the original payment,
- a clear description of the basis for the refund request,
- supporting documentation, if any.
Requests are reviewed on a case-by-case basis. Submission of a request does not guarantee a refund. AD•SCALE will respond within a reasonable time after receipt.
10.Refund Method and Timing
Approved refunds are issued to the original payment method whenever possible. Where the original method is unavailable, AD•SCALE may issue a service credit or arrange an alternative method at its discretion. Processing times depend on the payment provider and banking network and are typically completed within a reasonable number of business days after approval. AD•SCALE is not responsible for delays attributable to [PAYMENT PROCESSOR], banks or card networks.
11.Taxes and Currency
Refunds are issued in the original transaction currency and exclude any non-recoverable taxes, fees or foreign exchange differences. The customer is responsible for any taxes, duties or charges that may apply to a refund under its local laws.
12.Force Majeure
AD•SCALE is not liable, and no refund is owed, where performance is delayed, restricted or prevented by events beyond its reasonable control, including third-party platform decisions, government action, internet outages, cybersecurity incidents, payment provider disruptions, war, civil unrest, pandemics or natural disasters.
13.Changes to this Policy
AD•SCALE may update this Refund and Cancellation Policy from time to time. The updated version takes effect upon publication on [adscaleaccounts.com]. Continued use of the Services after the effective date constitutes acceptance of the revised policy.
